Facts:

Defendant was convicted in the Circuit Court in Baltimore (Maryland) of manslaughter by motor vehicle, pursuant to Md. Code Ann., Crim. Law § 2-209(b) (2005), reckless driving, and excessive speed. He appealed his manslaughter conviction. The defendant had previously been imposed with traffic ticket for speeding.

            The Maryland Court made the following holding:

  • The standard for an appellate court's review of the sufficiency of the evidence to support a criminal conviction is whether, on the evidence presented, taken in the light most favorable to the State, any rational trier of fact could have found the essential elements of the crime beyond a reasonable doubt.
  • In the context of manslaughter by vehicle, under Md. Code Ann., Crim. Law § 2-209(b) (2005), the element of "gross negligence" has been defined as a wanton or reckless disregard for human life. Maryland cases have suggested that excessive speed alone does not constitute gross negligence; hence, more is required to prove manslaughter by vehicle beyond a reasonable doubt. Excessive speed under certain circumstances, however, may be sufficient to establish the offense.
