Kingston v. State

Facts:

A jury in the Circuit Court for Baltimore (Maryland) convicted defendant of violating Md. Code Ann, Transp. § 21-801(a) and of driving while impaired in violation of Md. Code Ann., Transp. § 21-902(b). Defendant appealed the convictions.  On appeal, defendant argued that his conviction under Md. Code Ann., Transp. § 21-801(a) was not supported by sufficient evidence, arguing that excessive speed did not come within the purview of that section. The appellate court found that Md. Code Ann., Transp. § 21-801(a) required drivers to reduce speed to a reasonable and prudent level to account for existing conditions, external to driving behavior itself, that created actual and potential dangers.
