Kingston v. State
Facts:
A jury in the
Circuit Court for Baltimore (Maryland) convicted defendant of violating Md.
Code Ann, Transp. § 21-801(a) and of driving while impaired in violation of Md.
Code Ann., Transp. § 21-902(b). Defendant appealed the convictions. On appeal, defendant argued that his
conviction under Md. Code Ann., Transp. § 21-801(a) was not supported by
sufficient evidence, arguing that excessive speed did not come within the
purview of that section. The appellate court found that Md. Code Ann., Transp.
§ 21-801(a) required drivers to reduce speed to a reasonable and prudent level
to account for existing conditions, external to driving behavior itself, that
created actual and potential dangers.

- What is reasonable and prudent under Md. Code Ann., Transp. 21-801(a) is dictated by existing conditions. Md. Code Ann., Transp. 21-801(c) through (h) set forth specific conditions requiring a reduced speed: when there is special danger to pedestrians or other traffic, poor weather conditions, and when approaching any of the following: an intersection at which traffic is not controlled by a traffic control device, a railroad crossing, a curve, a crest of a hill, or when traveling on a narrow or winding road..
